This rental terms and conditions applies to all websites owned and operated by CV Nugraharta
Property.

1. Contract of Hire
All bookings are accepted by CV Nugraharta Property. and are subject to these conditions which are
deemed to have been accepted in full by the hirer and all persons in the party. Bookings can be made
by post, email or through the websites and would be deemed to be accepted once payment is received
by us.

2. Deposit
A non-refundable deposit of 50% of the total cost is required to secure your booking. If you make your
booking within 30 days prior to arrival (for high and peak seasons) or 60 days (for low season), full
payment is required to secure your booking. Your booking confirmation must be made by email or
telephone (followed by written confirmation) and will be held provisionally for five days within which the
payment has to be received into our account. If we do not receive within five days your provisional
booking will be released. Payments can be made by either credit card or bank transfer, consult our
Payment Instruction page for further detail.

3. Confirmation of Booking
Your booking is only safe when you receive the Booking Confirmation statement which we will issue
within 24 hours after your payment arrives into our account. Booking Confirmation will be sent to you by
email.

4. Final Payment
Remaining balance have to be paid before 30 days prior to arrival (for booking within high and peak
seasons) or 60 days (for booking within low season). We will issue an invoice at the latest 7 days prior
to the time when final payment has to be made. If for whatever reasons you fail to settle the final
payment before its due date, your booking will be automatically released and all the previous payments
you have made will not be refunded.

5. Form of Payment
Unless otherwise priorly agreed in writing, all payments prior to your arrival date shall be made either
by credit card or bank transfers. Please consult our Payment Instructions page for further details. If
there is no damage caused by your negligence occurs, refund of the security deposit will be made
either by cash or bank transfer at the latest one week after your departure.

6. Cancellation by Hirer
Cancellation in any cases will affect in full forfeiture of any payments you may have made related to
your booking. This is the case where travel insurance that covers these kinds of incident is highly
recommended.

7. Alterations and Cancellations by Us
In the unlikely event that a villa becomes unavailable due to circumstances beyond our control, we will
offer alternative period if possible, alternative accommodation if available, or a full refund of all
payments you have made. Refund is limited only to the rental costs. We are not liable to cover costs
that may incur related to your travel arrangement i.e. administration fee to reschedule your flight, etc.

8. Amendment Charges
Alteration to booking period can only be accepted upon availability of the villa. If your new period falls in
different season where higher price is applicable, you will have to pay the additional cost accordingly. If
your new period falls in different season where rental price is lower, no refund will be paid. If your new
period is longer than your initial period, you will have to pay the additional cost. If your new period is
shorter than your initial period, no refund will be paid. In any cases a US$50 administration fee is
applicable and the new period will only be confirmed as soon as all payments related to the change are
completed.

9. What is Included
The villa rental includes all the staffs, linen and towel changes, water, electricity, gas, and maintenance
of swimming pool and garden. Any defects and deficiencies must be reported within 24 hours of your
arrival otherwise it will be assumed that everything is in order.

10. What is Not Included
The villa rental prices do not include personal, travel and cancellation insurance, travel, transportation,
food and beverages, in-house massage and spa treatments and other similar extras unless priorly
agreed otherwise in writing.

11. Occupancy
Upon confirming your booking you will be required to list all members of your group. Only those appear
on the list may occupy the villa. In any cases the villa cannot be re-let or sublet to any other group/party
or individual written agreement with us. Under no circumstances you are allowed to exceed maximum
occupancy specified in the villa description without prior agreement in writing. CV Nugraharta Property
or its representatives reserve the right to refuse admittance to the villa if the hirer break this condition.
In any circumstances animals are prohibited at all of our villas.

12. Hirer’s Responsibility
The hirer is responsible for taking all reasonable care of the property and its contents. At the end of the
hire period, the property and its contents, including all equipment, furniture, utensils, etc. The hirer shall
ensure that no member of the party engages in any activity in or around the villa and swimming pool
which may cause damage, offence to the neighbours, pollution to the water or damage to the structure
or filtration equipment, this includes unacceptable anti-social behaviour.

13. Damage to Villa and its Contents
Except in the case of normal wear and tear, the hirer will be responsible for making good any damage
to the villa or its contents which has occurred due to negligence, willful damage or irresponsible
behaviour on the part of those occupying the villa or their guests. Such damage must be immediately
reported to the villa manager, CV Nugraharta Property, or their representative. The cost of the
replacement or damage must be paid for by the hirer prior to departure.

14. Rights of Access
CV Nugraharta Property, villa owner, villa manager, their representatives or their sub-contractors have
the right of access to the villa at any time with due regard to the convenience of the hirer for the
purpose of linen changes, inspection of the property and to carry out any essential or routine repair or
maintenance work.

15. Responsibilities
Neither villa owner, CV Nugraharta Property or their representatives can be held responsible for any
circumstances beyond their control including, but not limited to, mechanical breakdown, illness,
accident, as well as failure of any public service supply. The hirer responsible for booking undertakes
that no person will suffer anything to be done which would endanger the policy of the villa owner’s
insurers in respect of the villa and its contents which might make the same void or voidable.

16. Injury and Damage
CV Nugraharta Property acts as a booking agent on behalf of the owners of the properties we offer and,
as such, your contract is with the owner. We do not have any responsibility to compensate you for any
personal injury, illness, death, loss or damage of whatever nature suffered by you, or any member of
your party, during the booking period or thereafter.

17. Accuracy of Information
We always take a great deal of care to work with our owners’ to make sure that the information and
photography contained in this website to the best of our knowledge is correct. However all our villas are
privately-owned and therefore from time to time owners may make changes in their homes to details
like decoration, furniture and fittings. All information supplied by CV Nugraharta Property is given in
good faith and is based upon information available at the time. All reasonable measures have been
taken to ensure accuracy, but CV Nugraharta Property and their representatives are not liable for any
variation however caused.

18. Villa Arrival and Departure Times
The villa will be available for occupation from 5.00pm local time on the day of arrival and must be
vacated by 12.00am on the day of departure.

19. Keys, Directions and Local Contact Numbers
Key to the villa will be held by villa manager or villa staffs. Locking the villa and taking the villa along
when you leave is prohibited. Upon your arrival our representative welcoming you at the airport will give
yout details of persons you need to contact related to both issues with your stay at the villa or other
things related to your holiday.

20. Complaints
In the unlikely event that you have a complaint about the villa or its contents whilst on holiday, it must
be reported immediately to CV Nugraharta Property or its representatives who will take reasonable
steps to resolve the matter on behalf and in liaison with the owner of the property. Neither CV
Nugraharta Property or their representatives shall have any liability for any complaint submitted after
the completion of the hire period.

21. Building Work
In the event of building works taking place by local authorities, private developers or neighbours, it is
important to note that we are not responsible for such work, are unable to stop such work taking place
or unable to control the level of noise, neither can we be responsible for any building works that take
place during a holiday.

22. Force Majeur
We regret we cannot accept liability or pay any compensation where the performance or prompt
performance of our contractual obligations is prevented or affected by ‘force majeur’. In these Terms
and Conditions of Hire, ‘force majeur’ means any event which we or the supplier of the service(s) in
question could not, even with due care, foresee or avoid. Such events may include, but are not limited
to, war, threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural
disasters, fire, acts of God, terrorist activities, quarantine, epidemics, weather conditions, government
action or other events outside our control.

23. Law and Jurisdiction
CV Nugraharta Property acts solely as an intermediary booking agent on behalf of the property owners.
The rental contract is ultimately between the property owner and the hirer. Any disputes arising from
the hire of the property will be resolved between the hirer and the owner. This agreement shall be
governed by the laws of the Republic of Indonesia to which both parties expressly submit.

24. Insurance
The villa hire cost does not include any personal insurance cover of any kind. It is a condition of
booking that insurance is taken out against cancellation and it is strongly recommended that personal
accident and medical insurance is also taken out.
